Western Australians return to the polls on April 5 for a re-run of the Senate election that will choose the successors to those whose terms expire on June 30, the original result having been declared void after 1375 ballot papers went missing. The mishap occurred during a recount process that was initiated after the original result hinged upon a 14-vote margin at a particular point in the count, where the potential existed to deliver the final two seats on one scenario to Louise Pratt, the second Labor candidate, and Zhenya Dio Wang of the Palmer United Party, and on the other scenario to Scott Ludlam of the Greens and Wayne Dropulich of the Australian Sports Party. On either scenario, the first four seats were won by the three lead candidates of the Liberal Party, David Johnston, Michaelia Cash and Linda Reynolds, and the leader of the Labor ticket, Joe Bullock. Key to the fate of the last two seats was a point of exclusion in the count where the lead candidates of either Shooters and Fishers or the Australian Christians stood to drop out, with decisive implications for the subsequent flow of preferences.
When the recount was completed minus the missing votes, the Australian Christians candidate emerged 12 votes ahead, resulting in Ludlam and Dropulich being declared the winner in a result that all concerned recognised could not stand. The Australian Electoral Commission itself petitioned the High Court to have the result declared void, the only avenue for recourse in securing its preferred outcome of a fresh election. Submissions by some of the affected parties sought to have a result salvaged from the original election, in some cases by using data from the original count to cover the gaps created by the missing votes in the recount result. However, the High Court concurred with the AEC that this was legally impermissible and granted it the relief it sought. The bungled election resulted in the forced resignations of the Electoral Commissioner, Ed Killesteyn, and the commission’s state manager, Peter Kramer.
On either of the two potential outcomes, the September election result ended a long continuity in Western Australian Senate elections going back to the beginning of the modern era of six-seat half-Senate elections in 1990, each of which had delivered three seats to the Liberals and two to Labor, with the final seat going to either the Democrats or the Greens. This reflects the fact that Labor has consistently been too weak in Western Australia to win a third seat, but never quite so weak that it could not deliver the Greens or Democrats enough preferences to boost them to a quota. The state joined Tasmania in being a cradle of green politics, in large part due to the election in 1984 of Jo Vallentine as part of the short-lived Nuclear Disarmament Party. The profile Vallentine attained enabled her to win re-election at the 1987 double dissolution as an independent, and in 1990 as the candidate of the newly founded Greens WA. Their candidate Dee Margetts likewise won a seat at the 1993 election after outpolling a weakly performing Australian Democrats.
The Democrats vote surged over subsequent elections, progressively squeezing out Vallentine’s successor Christabel Chamarette in 1996 and Dee Margetts in 1998, while Labor’s direction of preferences to the Democrats ahead of the Greens won them one last victory in 2001. One Nation took a large bite out of the Liberal vote in 1998 and 2001, but on each occasion the early exclusion of the third Labor candidate left Labor, Democrats and Greens preferences deciding the final seat in favour of the Liberals. With the collapse of the Democrats at the 2004 election, the results in 2004, 2007 and 2010 followed the same pattern in delivering a clear three quotas to Liberal and two to Labor, with the final seat going to the Greens with help from Labor’s surplus. Their winning candidates were Rachel Siewert in 2004 and 2010, and Scott Ludlam in 2007.
The key to the breakage of the pattern in September 2013 was a slump in support both for Labor, down 3.1% on an already poor result in 2010 to 26.6%, and the Greens, down 4.5% on a strong 2010 result to 9.5%, leaving their combined vote below two quotas. The main parties of the left were thus competing for two seats with Labor potentially reduced to only one, a result without precedent in any state until last year (Labor likewise won only a single seat in South Australia). The other material factor was the surge in support for the proliferating micro-parties and the tight preference arrangements between them, which in a number of cases crossed what was generally understood to be the left-right divide. Given the combined micro-party was over a quota even without including the Palmer United Party, this created the potential for an almost random micro-party candidate to absorb the preferences of all the others and win a seat. The potential beneficiary to emerge was Wayne Dropulich, who polled 0.2% as the candidate of the Australian Sports Party. A similar scenario in Victoria secured the election of Ricky Muir of the Australian Motoring Enthusiasts Party from 0.5%. Perhaps reflecting the mining connection, Western Australia also produced a strong result for Palmer United, polling 5.0% and potentially securing it a third Senate seat to add to those won in Queensland and Tasmania.
The unprecedented circumstances of the re-election render the result extremely difficult to predict. Micro-party preference arrangements are somewhat less tight this time, with the Sex Party, Wikileaks Party and Animal Justice appearing to respond to controversies they faced at the September election when they favoured various right-wing concerns over the Greens. Nonetheless, potential paths to victory remain open for a micro-party unless their aggregate vote drops substantially. The Palmer United Party is also running a massive advertising campaign exceeding the efforts of either major party, and is likely to again feature strongly.
The Liberal ticket is headed by David Johnston, a former state party president who entered parliament from the number two position on the ticket at the 2001 election. Johnston secured the top of the ticket in 2007, reflecting his promotion to the outer ministry portfolio of justice in March 2007, from which he won further promotion to the shadow cabinet portfolios of resources and energy and tourism following the November 2007 election defeat. He was again promoted to defence at the time Malcolm Turnbull assumed the Liberal leadership in September 2008, and has maintained the portfolio in government.
Second on the ticket is Michaelia Cash, who was elected from number three in 2007 and now moves a position higher to fill the vacancy created by the retirement after 17 years of Alan Eggleston. Cash was an industrial relations lawyer before entering parliament, and is the daughter of a former Western Australian state MP, George Cash. She was initially preselected in 2007 for the all-but-unwinnable fourth position on the ticket, but was elevated to number three after the initial nominee, Mathias Cormann, found a quicker route to the Senate by filling the casual vacancy created by the resignation of Ian Campbell. Cormann had in turn won preselection at the expense of 70-year-old incumbent Ross Lightfoot. Cash was promoted to parliamentary secretary after the 2010 election, and thence to the outer ministry following the victory of 2013 as Assistant Minister for Immigration and Border Protection and Minister Assisting the Prime Minister for Women.
Replacing Cash at number three is Linda Reynolds, who was progressively chief-of-staff to former Senator Chris Ellison, a project director with defence company Raytheon, deputy federal director of the Liberal Party, and an adjutant-general with the Australian Army. Reynolds was the most obvious loser of the 2013 Senate election debacle, having clearly won a seat on either of the two possible scenarios and now required to try her hand again in the far less favourable circumstance of a statewide by-election.
Labor’s ticket is headed by debut entrant Joe Bullock, state president and former state secretary of the Right faction Shop Distributive and Allied Employees Association. Bullock attained the position with the factional muscle of his own union together with that of the Left faction United Voice, part of a deal in which the nominee of the latter, Sue Lines, filled the casual vacancy created by the retirement of Chris Evans in early 2013. In doing so he effectively displaced from the Senate ticket his factional colleague Mark Bishop, who was his predecessor as SDA state secretary, and displaced the other incumbent, Louise Pratt, from the number one position she held at the 2007 election. With Labor’s malaise in Western Australia raising the prospect of it being reduced to a solitary seat, the ordering of the top two positions was of greater than usual consequence, and the awarding of the only secure position to a factional heavyweight was widely criticised.
Louise Pratt entered politics as a member of the state’s upper house in 2001, having previously worked as an electorate officer to Carmen Lawrence and achieved prominence in Perth’s gay community. Her preselection for the Senate at the 2007 election was achieved with backing from the Left faction Australian Manufacturing Workers Union and its powerful state secretary, the late Jock Ferguson, which had withdrawn support from incumbent Ruth Webber following complicated preselection disputes ahead of the 2005 state election, with the effect that Webber had to settle for the losing number three position. Pratt won backing from an alliance of Left unions and the New Right, through a deal in which her vacant state seat went to Vietnamese community leader and “New Right” faction operative Batong Pham. Pratt’s success in securing top place was an early marker of the declining career fortunes of Mark Bishop, who had announced his intention to retire in 2006 before changing his mind after Kevin Rudd assumed the leadership that December. Bishop appeared set to be succeeded by the party’s state secretary Bill Johnston, another member of the SDA Right, who would instead enter state politics in 2008 as the member for Cannington.
Number three on the Labor ticket is Shane Hill, who held the regional seat of Geraldton in the state parliament from 2001 until his defeat in 2008.
Seeking re-election for the Greens is Scott Ludlam, who entered politics at the 2007 election via a position as adviser to the other Greens Senator from Western Australia, Rachel Siewert, and previously with state MP Robin Chapple. Ludlam emerged as one of the Greens’ highest-profile Senators during his term, among his most notable causes being advocacy for Julian Assange. This did not stop the Wikileaks Party placing him behind the Sports Party and the Nationals on its preference ticket, provoking the ire of Assange’s mother Christine Assange and alienating key party supporters. However, it was a substantial drop in the Greens’ vote off the high of 2010 together with the slump in Labor support that left him unsure of victory at the September 2013 election, with Labor’s failure to reach a second quota depriving the party of its surplus as preferences. The election stand-off has at least had the effect of further raising Ludlam’s profile, to which he further added when a parliamentary speech attacking Tony Abbott received over 800,000 hits on YouTube in the month before the re-election.
The lead Palmer United Party candidate is Zhenya Dio Wang, a civil engineer and chief executive of Australasian Resources, in which Clive Palmer is a major investor. Wang was not widely known in political circles at the time of his surprise win on the first count after the September election, which was subsequently overturned on the result of the botched recount. The Australian reported in October that Australasian Resources had been saved from the risk of insolvency in the past three months by cash injections from the resources tycoon totalling $421,000. Wang is taking a considerably lower profile in the party’s advertising than its rather better-known number two candidate, Des Headland, who played 114 games for the Fremantle Dockers between 2003 and 2010, and 52 for the Brisbane Lions previously.

Nationals candidate Shane van Styn is a Geraldton councillor and corporate consultant who ran for Durack at last year’s federal election in September, and for Geraldton at the state election the previous March.
Noted euthanasia proponent Philip Nitschke is bringing his public profile to bear as the candidate of the Voluntary Euthanasia Party, for which he ran as Senate candidate in the Australian Capital Territory in September.
Anthony Fels, who represented Agricultural region in the state upper house from 2005 to 2009, first as a Liberal and then for Family First at the tail end of the term, is running for a new concern called the Mutual Party.
Wayne Dropulich of the Australian Sports Party is a civil engineer who emerged in the public eye in the immediate aftermath of the September federal election when early projections suggested he stood to pull off a shock victory. When the final count determined he had been narrowly defeated, he together with the Greens sought and were granted the fateful recount that resulted in the election being declared void.
James Moylan of Help End Marijuana Prohibition has attracted media attention due to his success in garnering preferences from a number of unlikely sources, leading to speculation he may emerge the re-elections preference-harvesting success story. Media reports have been keen to note that he lives in Queensland, and was unable when asked to name the Western Australian Premier, whom he thought might be called Barrett.
The candidate of the Sex Party is its national president, inner-city Melbourne resident Fiona Patten.
